Common Violations
Some of the most common code violations are:
Issue Town regulations Grass Must be maintained to a height of 6 inches or less. If the grass is over 6 inches in height it is in violation and must be cut. Abandoned Vehicle No residential property owner is permitted to keep a motor vehicle that is unlicensed/unregistered, or a vehicle that is not roadworthy (intact with no flat tires), on their property, unless it is stored in a completely enclosed building. Storage of Recreational Vehicles From April 1st to November 1st, one recreational vehicle may be stored on the driveway extending beyond the property's front building line, if setbacks are met. For the remainder of the year, they must be stored behind the property's front building line. Maximum of two on-premises any time of year. Garbage/Refuse on the Front Lawn No person shall accumulate or permit the accumulation of garbage/refuse upon any premises owned or occupied by him or her except for the purpose of regular weekly garbage removal or active construction. Parking on the lawn No required front or side yard or portion thereof, other than driveways, in any R-R, R-1, R-2, R-3, or R-6 Residential District shall be utilized to provide parking spaces required in this chapter.
While there is an established timeframe for the enforcement process, it can vary based on the violation type and the associated risk(s) to health and safety. The Code Enforcement Unit has some discretion in addressing code violations and provides property owners with the appropriate time to bring their property into compliance with Town Code.The Town Code Enforcement unit will inspect complaints received, but they can only issue code violation notices for conditions that are prohibited under Town Code.

The right-of-way includes the sidewalk and grass area between the sidewalk and the road (approximately 10-15 additional feet on either side of the road). Generally, utility lines such as Electric, Gas Oil, water, sanitary sewers, and storm sewers are housed in the right of way.
Please note that the 199 Permit includes driveways.

Applications to license your dog can be obtained in the Clerk's Office at Town Hall or on the Animal Control page. Yes. To apply for a handicap tag, you must provide a valid driver’s license and a note from your doctor specifying if you need a permanent or temporary tag and for how long (if temporary). You may have someone else come in for you. They must bring your driver's license and the form filled out with your signature.

You must fill out a Marriage Research Application form (PDF). It must be filled out by one of the two parties involved in the marriage or a Power of Attorney. The form must be notarized and there is a search fee of $10. The marriage license is filed where you applied for your license, not necessarily where you were married.

To apply for a marriage license, both parties must be present. You must bring your original birth certificate or a certified copy and a valid driver’s license. If you have previously been married, a judgment of divorce, divorce decree or death certificate is required. You must apply for the license at least 24 hours before the ceremony and no further in advance than 60 days. There is a $50 fee to obtain this license.

Yes, Monroe County’s Economic Development Division, Imagine Monroe, offers assistance to local businesses in the form of workforce training and recruiting, as well as offering several tax rebate and loan programs your business may be eligible for.
The Town also offers a Business Investment Exemption. This 10-year exemption, passed in 2015, provides tax relief to businesses investing in commercial and industrial development in the appropriate business permitted zones in Irondequoit. The exemption schedule allows property owners to gradually absorb the increases in assessed value that often result from physical enhancements or expansion. For more information about the criteria and guidelines, please contact the Assessor’s office.

For any new business, the following permits are always required:
- Change of Occupancy - The application addresses information about the change in business/owner and includes a safety inspection by the Fire Marshal prior to the issuance of a Certificate of Occupancy to the new business. The change of occupancy/use application form is available online.
- Signage - Replacement of existing signs, sign panels, or free-standing signs and/or the installation of new signs requires a building permit be issued before the work is performed. View an online copy of the Building Permit Application (PDF).
Depending on the type and location of the new business, there may be other reviews required, including, but not limited to:
- Building Permit - Changes to the exterior or interior space may require a building permit if it involves modifications to structural elements (walls, doors, windows) or electrical or plumbing work.
- Fire Marshal Permit - The new occupancy may require permits issued through our Fire Marshal's office, including but not limited to: alarm systems, sprinklers, gas appliances, and kitchen equipment.
- Board Reviews - New businesses may require review and approval by the Planning Board, Town Board, and/or Zoning Board of Appeals. If your new business requires an application to one of these boards, a staff member in the Planning and Zoning Department will be in touch once the Change of Occupancy application has been received.

The permit review process varies based on the type of permit and the number of applications under review at a given time. Generally, the review requires 7 to 10 business days, however, during peak building season the reviews may take up to 15 business days.

Permits are required when a project involves framing, insulation, plumbing, electric, foundation work, structural additions/alterations (e.g. addition or removal of walls, changes to size of exterior openings) and/or occupancy of new space (e.g. basement and attic remodeling, etc.). The permit requirements are governed by the New York State Uniform Code.
Cosmetic changes such as paint and carpet, and in-kind replacement of fixtures in the same location (e.g. toilet, sink) do not require a building permit. For more information or to verify whether your project requires a permit, please check the Building Permit Requirements Sheet or contact the Building Department.
Please be advised that failure to obtain a required building permit is a violation of the Town Code, which can result in Code Enforcement action and/or additional permit review fees associated with the as-built condition(s).

A Building Permit Application (PDF) must be accompanied by a survey map of the property and specifications and/or building plans related to the project. Please note that based on the scope of the project, the application may require the plans to be prepared by a New York State-licensed design professional (i.e., engineer, architect, landscape architect).

Property owners can perform the work themselves but must be able to meet the New York State Uniform Building and Fire Code requirements of their project. Also, they must complete and sign an affidavit indicating that their homeowner's insurance will cover them and the property while the work is underway.

Your court date is specific to your case. Please contact the Irondequoit Town Court at 585-336-6040 to speak with the Court Clerk.

If you have an attorney, contact your attorney, do not call the court. If you do not have an attorney, you must have a valid excuse for seeking a new appearance date (also called an adjournment). Proof may be required. Please note that while the Court will seek to accommodate all reasonable requests, you are not entitled to an adjournment and the Court is not required to offer you a new appearance date.
To request an adjournment, please call the Irondequoit Town Court at 585-336-6040 a minimum of 24 hours before your scheduled appearance. Failure to appear in court may result in a warrant being issued for your arrest.
Additional information regarding adjournments:
- Appearances on criminal charges (Misdemeanors and Felonies) cannot be rescheduled.
- Under no circumstances will the Court offer more than three adjournments of an appearance date.
- You may only request an adjournment in person or by phone. Under no circumstances will adjournment requests be accepted via email or through a third party.

There are three ways to answer a traffic ticket:
- Plead Guilty by mail (Section A of your ticket). Print your name and current address, including zip code, date, and sign. A fine and surcharge will be imposed by the Court and you will be notified by mail, with payment instructions.
- Plead Not Guilty by mail (Section B of your ticket). Print your name and current address, including zip code, date, and sign. A new court date will be mailed to you at which time you will be scheduled for a conference with the Assistant District Attorney assigned to Irondequoit Town Court. This should not be understood as a personal appointment and traffic matters are heard at the end of the criminal docket.
- Personally appear on the court date stated on the face of your ticket (located at the lower left corner of your ticket). The Assistant District Attorney will screen your ticket at that date and time.

Whether or not you need an attorney to handle your traffic infraction is a personal decision that only you can make. If your license is in jeopardy based on the point system or if a traffic charge resulted from an accident, you are advised to consult an attorney. If you are not the defendant, bail will be released by the Judge when the case is disposed of. If the case is transferred to Grand Jury, you must wait until an order is received from the Superior Court. Bail is returned via check and is not available for pickup for approximately 1 week after release. Please note that a 3% bail poundage fee may apply.
If you are the defendant, bail will be released:
- After your case is disposed of.
- After you have successfully completed your community service where required.
- After any fines are paid (unless bail is applied to the fine).

Payments for parking violations can be made in one of the following ways:
- Pay the fine in person at the Irondequoit Town Court at 1300 Titus Avenue, Rochester, NY 14617 during regular business hours (Monday through Thursday 9 am to 5 pm, or Friday 8 am to 4 pm).
- Mail the pre-addressed parking violation into the court with payment via money order (personal checks are not accepted).
- Make payment via credit card using the GovPayNow website (visit the Town Court page). Please note that a 4% service charge will apply.

Surcharges are mandatory charges required by Statute, with all revenues going to the State of New York. For convictions under the Vehicle and Traffic Law, mandatory surcharges are governed by V&T Law Section 1809. Convictions pursuant to the Penal Law are governed by Penal Law Section 60.35.

After 30 days, the fine due for a parking ticket doubles. Failure to pay a parking ticket may result in the suspension of your registration.

You must have a criminal complaint filed in order for the Judge to issue an order of protection. Please go to the Irondequoit Police Department at 1300 Titus Avenue to file a criminal complaint. Once the complaint is signed, it will be forwarded to the court. At the defendant's court appearance, the Judge can order that an order of protection be issued.

Filing Fees for Small Claims actions are based on the number of damages being sought;
- $10 fee for claims of $1,000 or less
- $15 fee for claims from $1,001 to $3000.
Filing fees must be paid at the time of filing Small Claims actions with the court. Please note that filing fees for Small Claims cases are non-refundable.

Upon submission of the appropriate forms and payment of the Small Claims fee (see above), notices will be mailed by the Court office to both parties indicating the date and time of the hearing. Bring any appropriate evidence and/or witnesses to the hearing. The regular rules of evidence are enforced by the presiding judge.
